Types of violations and definitions

  1. A violation of Company Policies and Regulations

 is when the Company’s personnel do not follow/comply with the company’s written regulations and rules. Example :

  • Carelessly or deliberately damaging, eliminating, or letting company property to be in a state of danger that may cause harm to the company
  • Eating and smoking outside of meal/break times or outside the designated areas
  • Conducting agitation, intimidation, or other actions that may cause a strike or slow down work activities in the company or a department
  • Delay incoming deposits for more than 24 hours working days
  • Revealing or divulging company secrets that should be kept secret except for the interests of the state, either directly or indirectly for personal gain or other external parties that will harm the company
  • Record attendance/return for fellow workers and abuse work time recording
  • Defamation of the company, which may either directly or indirectly cause losses to the company
  • Deliberately misusing sick certificates
  • Failure to report serious and/or infectious diseases that can endanger the life or health of other workers
  • To sleep while on duty
  1. Abuse of Authority

is when any person would benefit themselves or another person or a corporation, by misusing his / her authority, opportunity, or means because his/her position or position can harm the company’s finances and/or business. Example :

  • Misuse the authority/trust given by the company when dealing with outside parties or when making contracts. Conducting transactions with outside businesses by using the company name or representing the company for personal gain
  • Using without permission / misusing company property
  • Meninggalkan pekerjaan tanpa ijin atasan dan atau melakukan urusan pribadi tanpa ijin atasan sewaktu bertugas
  1. Extortion

can be defined as forcing people to hand over goods or money and so on with threats. Example :

  • Carry out illegal levies within the company environment
  • Pressuring and/or influencing and/or persuading dealers and/or suppliers and/or partners to get personal gain that may be detrimental to the company
  1. Fraudulent Deeds

are dishonest acts which includes actions such as fraud, forgery, concealment, or removal of important company documents/reports by Company personnel such that it may cause harm to the Company or other parties. Example :

  • Provide false or falsified information or falsify or hide information, files, documents, vouchers, receipts that causes harm to the company
  • Not giving up other income that belongs to the company (Other income is all income from the sale of company-owned goods other than commercial seeds)
  • Add, reduce or change the contents of company documents, memos, letters, announcements, files, and other files belonging to the company without permission from management
  1. Conflict of Interest

is a situation or condition in which the Company’s Individuals who have the power and authority have or are suspected of having a personal / group interest in the use of their power and authority to harm the Company and affect the Company’s quality and performance. Example :

  • Working with other parties/companies while still under a work contract with the company and outside the knowledge and permission of the management
  1. Gratuities

is the activity of giving and/or receiving Gifts / Souvenirs and Entertainment, which is carried out by the Company’s personnel with their authority/position in the Company, so that it may cause a conflict of interest that affects the independence, objectivity, and professionalism of the Company’s personnel. Example :

  • Borrowing money and/or goods and/or obtaining services from dealers/suppliers, especially those that will significantly affect business relationships
  • Request and or receive gifts, commissions, or entertainment from third parties
  1. Offenses against morality, ethics, social standards and racial relations

as well as racist behaviour that does not following the values of decency, both from the perspective of humanity (religion) individually and from society as a whole. Example :

  • Drunkenness, drinking intoxicating liquor, using and or distributing narcotics, psychotropic substances, and other addictive substances in the work environment
  • Eating and smoking outside of meal/break times or outside the designated places
  •  Committing immoral acts and sexual harassment in the work environment.
  1. Theft

is the activity of taking goods / something, either wholly or partly belonging to another person with the intention of owning the goods and breaking the law. Example :

  • Take or try to take or remove company property (such as seeds, samples, crops, materials, equipment or documents) by falsifying or cooperating with other people for personal gain
  • Committing fraud, theft or embezzlement of goods and/or money belonging to the company / co-workers
  1. Threatening Security

is an activity that harms or injures another party and is related to one’s security and safety. Example :

  • Owning and carrying dangerous weapons in the company’s work environment
  • Assaulting, abusing, threatening, or intimidating co-workers at work

1 Bekerja dengan pihak/perusahaan lain selagi masih terikat kontrak kerja dengan perusahaan dan di luar sepengetahuan dan ijin dari manajemen
2 Dengan ceroboh atau sengaja merusak, menghilangkan atau membiarkan dalam keadaan bahaya barang milik perusahaan yang menimbulkan kerugian bagi perusahaan
3 Mabuk, minum-minuman keras yang memabukkan, memakai dan atau mengedarkan narkotika, psikotropika dan zat adiktif lainnya di lingkungan kerja
4 Makan dan merokok di luar waktu makan/istirahat atau di luar tempat yang telah ditentukan
5 Melakukan agitasi, intimidasi atau tindakan lain yang menyebabkan mogok kerja atau memperlambat aktivitas kerja di perusahaan atau suatu bagian/departemen
6 Melakukan penipuan, pencurian atau penggelapan barang dan atau uang milik perusahaan/milik teman kerja ataupun milik teman perusahaan
7 Melakukan penundaan uang setoran masuk lebih dari 24 jam hari kerja
8 Melakukan perbuatan asusila dan pelecehan seksual di lingkungan kerja
9 Melakukan pungutan liar di lingkungan perusahaan
10 Memakai tanpa ijin/menyalahgunakan barang-barang milik perusahaan
11 Memberikan keterangan palsu atau yang dipalsukan atau memalsukan atau menyembunyikan informasi, arsip, dokumen, voucher, tanda terima dan sejenisnya sehingga merugikan perusahaan
12 Membongkar atau membocorkan rahasia perusahaan yang seharusnya dirahasiakan kecuali untuk kepentingan negara, baik secara langsung atau secara tidak langsung baik untuk keuntungan pribadi ataupun pihak luar lainnya yang akan merugikan perusahaan
13 Memiliki dan membawa senjata yang membahayakan di lingkungan perusahaan
14 Meminjam uang dan atau barang-barang dan atau memperoleh jasa dari dealer/supplier, terutama yang secara nyata akan berpengaruh terhadap hubungan bisnis
15 Meminta dan atau menerima hadiah, komisi atau entertainment dari pihak ketiga
16 Menambah, mengurangi atau mengubah isi dokumen perusahaan, memo, surat, pengumuman, arsip, dan file lain milik perusahaan tanpa ijin dari manajemen
17 Mencatatkan hadir/pulang untuk sesama tenaga kerja dan menyalahgunakan pencatatan waktu kerja
18 Mencemarkan nama baik perusahaan, yang berdampak baik secara langsung atau secara tidak langsung menimbulkan kerugian bagi perusahaan
19 Menekan dan atau mempengaruhi dan atau membujuk dealer dan atau supplier dan atau rekanan untuk mendapatkan keuntungan pribadi dan atau dapat merugikan perusahaan
20 Mengambil atau mencoba mengambil atau mengeluarkan barang milik perusahaan (seperti benih, sample, hasil panen, material, peralatan atau dokumen) dengan cara memalsukan atau bekerja sama dengan orang lain untuk kepentingan pribadi
21 Meninggalkan pekerjaan tanpa ijin atasan dan atau melakukan urusan pribadi tanpa ijin atasan sewaktu bertugas
22 Menyalahgunakan surat keterangan sakit dengan sengaja
23 Menyalahgunakan wewenang/kepercayaan yang diberikan perusahaan saat berhubungan dengan pihak luar atau saat pembuatan kontrak. Bertransaksi bisnis di luar menggunakan nama perusahaan atau mewakili perusahaan untuk keuntungan pribadi.
24 Menyerang, menganiaya, mengancam, atau mengintimidasi teman kerja di lingkungan kerja
25 Tidak melaporkan penyakit serius dan/atau menular yang dapat membahayakan kehidupan atau kesehatan tenaga kerja lain
26 Tidak menyerahkan pendapatan lain – lain yang menjadi milik perusahaan. (Pendapatan lain – lain adalah semua pendapatan hasil penjualan barang milik perusahaan di luar benih komersial)
